This End User License Agreement ("Agreement") is a contract between you ("you", the restaurant) and Command.Restaurant ("Command.Restaurant", "we", "us") governing your use of the Command.Restaurant service, owner control center, and related applications and integrations (together, the "Service"). By accessing or using the Service, you agree to this Agreement. If you do not agree, do not use the Service.
Subject to this Agreement, Command.Restaurant grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for the purpose of operating your restaurant's online ordering and related operations. We retain all rights, title, and interest in the Service.
The Service is intended for restaurant businesses and their authorized staff, not for the general public. You are responsible for the accuracy of the information you provide, for the activity of users you authorize, and for keeping your credentials secure.
The Service facilitates order intake and routing. Command.Restaurant is not a payment processor and does not collect payment for orders; payment occurs directly between you and your customer (for example, at your counter). You are solely responsible for accepting, preparing, and fulfilling orders; for the accuracy of your menu, prices, availability, and allergen/nutritional information; for collecting and remitting applicable taxes; and for compliance with food-safety and other laws applicable to your business.
You agree not to misuse the Service, including not to: reverse engineer, decompile, or attempt to extract source code; interfere with or disrupt the Service or its security; use it to send unlawful, infringing, or harmful content; or use it in violation of applicable law or the rights of others.
New restaurants and currently unsubscribed restaurants can choose one free launch per restaurant after completing setup. No payment card is required. Existing paid subscriptions keep their contracted price and terms.
The free launch covers the restaurant’s first CAD $1,000 in qualifying sales recorded through Command.Restaurant, including previous qualifying sales. Qualifying sales are completed food-item sales after discounts. Taxes, tips, delivery charges, cancelled orders and refunded amounts are excluded. Pickup orders that are not cancelled are automatically treated as completed after their scheduled pickup day (or order day if no pickup date is set), even when you fulfill them from printed tickets without updating their status on screen. Cancel orders you do not fulfill. Your dashboard shows counted sales and the remaining allowance; any in-progress sales estimate does not count until completion. There is no time limit, and creating another account does not reset the allowance. Once the threshold has been reached, later refunds do not restart the free launch. Activating a paid subscription ends any unused free allowance.
Once the allowance is reached, new orders pause until you choose a subscription. The order that crosses the threshold and other existing orders can still be fulfilled; your menu, order history and billing remain accessible.
To continue taking new orders, you must explicitly approve a subscription at CAD $79 per month plus applicable taxes through PayPal. Reaching the threshold never creates a subscription or charges you automatically. The checkout shows the first payment and recurring monthly total before approval. After approval, the subscription renews monthly until cancelled. You can cancel anytime from Subscription & billing. Existing paid-through access remains available until the date shown there.
The Service, including its software, design, and content provided by Command.Restaurant, is owned by Command.Restaurant and protected by law. You retain ownership of your own business content (such as your menu and branding) and grant Command.Restaurant the rights needed to host and display it to operate the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ORDERS OR PRINTS WILL ALWAYS BE DELIVERED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMAND.RESTAURANT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID TO COMMAND.RESTAURANT FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold Command.Restaurant harmless from claims, damages, and expenses arising out of your use of the Service, your content, your orders and their fulfillment, or your violation of this Agreement or applicable law.
This Agreement applies while you use the Service. You may stop using the Service and disconnect any integrations at any time. We may suspend or terminate access if you breach this Agreement or to protect the Service. Provisions that by their nature should survive termination will survive.
This Agreement is governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The parties submit to the courts located in Quebec for any dispute, to the extent permitted by law.
We may update this Agreement from time to time. The "Last updated" date above reflects the most recent revision; continued use of the Service after a change means you accept the updated Agreement.

Promo Dollars program. The Merchant acknowledges that the Platform operates a loyalty program, Promo Dollars. Customers earn Promo Dollars on orders placed with the Merchant through the Platform, whether or not the Merchant participates in the program. Earning costs the Merchant nothing and changes neither its prices nor the amount it receives. Promo Dollars earned this way can be used at any merchant that chooses to accept them, including other restaurants. The Merchant cannot exclude its orders from earning. Acceptance is enabled by default at 15% of the eligible subtotal of takeout orders in the app. The Merchant can choose 10%, 15%, 20% or 25%, or opt out, in its Control Center. Any signed-in admin, owner or team member with access to the restaurant can change this setting, effective immediately for new orders. No separate participation agreement or signature is required. Previously saved choices are preserved. The Merchant funds the discount before tax, with no reimbursement from Command.Restaurant. Discounts on already confirmed orders remain unchanged.
